That’s what’s at stake.

Where: The U.S. Senate, and every acre of federal public land. The bill is S. 5653, the Bipartisan American Affordability and Jobs Act, from Sens. Capito (R-WV), Lee (R-UT), Whitehouse (D-RI), and Heinrich (D-NM).

What’s happening: Last week I told you about this permitting bill. The Senate’s first vote is Monday, Nov 9, and new analysis this week shows what it would mean for a rush that’s already underway. The Bureau of Land Management is now weighing at least 35 applications for data centers and related infrastructure on more than 24,000 acres of public land in Arizona, Idaho, Nevada, Oregon, Utah, and Wyoming. One proposal in eastern Utah would cover more than 9,000 acres and run on small nuclear reactors. There’s no permitting process for data centers on public land at all. The first one approved, near Boulder City, Nevada, skipped a new environmental review and public comment, and a judge just sent it back to start over.

Why it matters: The Center for Western Priorities says three parts of the bill would make approvals like that permanent:

Section 1401 locks permits in. Agencies couldn’t revoke or change any federal permit in effect on or after Sept 16, 2026. If a court finds the environmental review was flawed, construction keeps going while it’s redone, and challengers get just 150 days to sue.

Section 1402 makes taxpayers pay. If an agency changes an approved permit and the project can’t go forward, taxpayers would owe the developer 25 to 50 percent of what it has spent.

Section 2215 is a mining giveaway. Mining companies could claim nearly unlimited public land for waste dumps, roads, pipelines, and power lines tied to a mine.

The bill also requires just one public comment period, at the start, and only for the most harmful projects. That’s the land hunters, anglers, hikers, and riders use now, and once it’s locked in, it doesn’t come back.

A fair note: This bill is bipartisan, and it would also speed up power lines and renewable energy. Sen. Heinrich, a longtime public lands champion, says it “will age very well.” The ask isn’t “kill permitting reform.” It’s “fix these sections, and don’t hand our public lands to data centers before the public gets a say.”

Deadline: The first vote is Monday, Nov 9. Call before then.

Take action (2 minutes): Call your two senators through the Capitol switchboard at (202) 224-3121, or look up their direct lines. Say: “I’m a constituent from [town]. Please oppose the permitting bill, S. 5653, unless Sections 1401, 1402, and 2215 are removed. How much bond is set aside for cleanup if the operator walks away? And what does 20 years of pits and trenches mean for the deer, elk, and sage grouse that use this country?

A fair note: The plan calls for reclaiming each site as mining moves on, and there’s no blasting.

Where: The U.S. Senate, with every acre of federal public land at stake. The bill is S. 5653, the Bipartisan American Affordability and Jobs Act, from Sens. Capito (R-WV), Lee (R-UT), Whitehouse (D-RI), and Heinrich (D-NM).

What’s happening: This 417-page bill rewrites the National Environmental Policy Act, the Endangered Species Act, the National Historic Preservation Act, and mining law in one package. The Senate’s first procedural vote is set for Monday, Nov 9, right after the election, when the senators come back.

Why it matters: Three sections stand out, according to The Wilderness Society’s analysis:

Section 1401 locks permits in. Future administrations couldn’t act on permitted projects, even ones approved unlawfully. That would entrench drilling and mining in places like Bears Ears, Grand Staircase-Escalante, the Boundary Waters, and the Arctic.

Section 2215 is a mining giveaway. Companies could occupy public land for waste dumps and infrastructure without valid mineral rights, without paying royalties, and without rigorous review. That shuts out the hunters, anglers, hikers, and riders who use that ground now.

Section 1402 blocks a timeout. Developers could sue when approvals “take too long,” which could stop any future pause on things like data centers on public lands.

It also weakens public comment and tribal consultation and limits challenges in court. In other words, it narrows the very tools this newsletter asks you to use every week.

A fair note: This bill is bipartisan, and some clean-energy groups and unions support it, because it would also speed up power lines and renewable projects. The ask here isn’t “kill permitting reform.” It’s “don’t trade away public lands to get it.”

Our public lands shouldn’t be locked into drilling and mining for good.”
<p class="button-wrapper"

Where: Fall Creek watershed, Middle Fork Ranger District, Willamette National Forest, east of Eugene, Oregon

What’s happening: The Forest Service wants to commercially thin 11,906 acres and sell about 190 million board feet of timber in up to 20 sales over roughly a decade. Logs would be hauled over 325 miles of road, including in the wet season, with about 21 miles of new temporary road. Most of the logging (8,649 acres) is in Late-Successional Reserves, the forest set aside to grow back into old growth.

Why it matters: Anglers, first. Fall Creek and two tributaries are already listed as too warm for fish year-round. About 65 percent of threatened spring Chinook die there before they can spawn, and the agency’s own analysis says the project is likely to harm them. Hunters next: across 11,906 acres of logging and 325 miles of haul road, the document never analyzes deer or elk forage, cover, or disturbance. And 63 spotted owl home ranges overlap the project, with most location data dating to surveys from the 1990s.

A fair note: This is thinning of 42- to 79-year-old plantations, not clear-cutting old growth, and the agency’s own modeling shows the thinned trees would grow faster.

Where: Grand Canyon National Park, North Rim, Arizona, on the Kaibab Plateau

What’s happening: A wildfire burned about 71,130 acres of park land and destroyed about 106 of the North Rim’s 229 structures, including the historic Grand Canyon Lodge. Now the Park Service is choosing how to rebuild, and it has put out three concepts:

Concept A: keeps today’s season, about May 15 to Nov 30

Concept B: stretches it to about April 1 to Jan 5

Concept C: opens year-round, with more lodging, camping, and buildings, and a shuttle from a park-and-ride for much of the rim

Every concept moves the North Kaibab Trailhead to CC Hill and paves a new parking lot there. None of them says how big it would be.

Why it matters: The North Rim has always been the quiet side of the canyon. The park’s own plan says it should stay “low-key and uncrowded,” yet Concept C is built to add capacity. Concepts B and C would bring winter traffic to a plateau where Highway 67, the only paved road in, is closed in winter, and none of the materials says what keeping it open would cost wildlife. Rim-to-rim hikers, backpackers, and the hunters and wildlife watchers who know the Kaibab Plateau all have a stake. And the Park Service plans to study environmental effects only after it narrows the concepts. Comments now can keep all three options on the table until the effects are known.

A fair note: The North Rim has to be rebuilt, and more access helps some visitors and local businesses. The ask is “rebuild what was lost, keep it quiet, and show us the full footprint before you choose.”

Deadline: Friday, Nov 6

Take action (2 minutes): Tell the Park Service the North Rim should stay low-key and uncrowded, and ask it to compare all three concepts side by side in its environmental review, including the CC Hill parking lot and what winter access would require → Comment on the North Rim rebuild (or go straight to the Park Service comment page)

Comment on North Rim Rebuild

Groups working on this: I haven’t found a group with a public campaign on the rebuild yet. Illustration: AI-generated

Where: The Arctic deposit on the upper Kobuk River, in the Brooks Range foothills of northwest Alaska. The permit decision belongs to the U.S. Army Corps of Engineers.

What’s happening: Ambler Metals wants to dig an open-pit copper, zinc, and lead mine that would process about 11,000 tons of ore a day for about 13 years. It would permanently fill about 121 acres of wetlands and streams and hold its tailings behind a dam at the headwaters of Subarctic Creek. The ore would be trucked out on the Ambler Road, a 211-mile industrial road still being fought in court. This is the first of the mines that road was built to open. Water treatment would have to continue after the mine closes, and the company’s own filing prices the first century of it at about $1.1 billion.

Why it matters: Caribou hunters, first. The Western Arctic Caribou Herd has fallen from 490,000 animals in 2003 to 121,000 in 2025, and between 88 and 95 percent of households in the Kobuk River villages rely on caribou. Anglers too: the upper Kobuk holds the largest spawning sheefish run in northwest Alaska, and Dolly Varden spawn in the creek where the tailings would go. Hikers and river floaters lose as well, because the road crosses about 26 miles of Gates of the Arctic National Preserve. And every taxpayer should ask who pays for a hundred years of water treatment if the company walks away.

Deadline: Monday, Nov 2

Take action (2 minutes): This is scoping, when the Corps decides what its review has to cover. Ask it to study the whole mining district the road would open, not just one pit, and to say who pays for water treatment after closure

Comment on the Arctic Mine

Groups fighting the Ambler Road: Northern Alaska Environmental Center, lead plaintiff in the lawsuit over the road’s permits, with Trustees for Alaska as counsel. The Forest Service calls its decision an administrative step, but once leases are issued, companies gain the legal right to explore and develop. The tribes whose ancestral lands these are, since the notice never mentions tribal consultation. Photo: La polizia at English Wikipedia

Where: Dixie National Forest, Cedar City Ranger District, around the town of Brian Head, next door to Cedar Breaks National Monument

What’s happening: Brian Head Resort wants to grow its permit on national forest land from 887 acres to 2,538, adding 14 lifts and 359 acres of clear-cut, graded ski runs. It would more than double daily capacity to 9,710 skiers. The Forest Plan would be amended to fit it.

Why it matters: Water first. The Forest Service’s own draft says snowmaking would run about 103 acre-feet a year short of the resort’s dedicated water supply. A study of whether resort wells draw on Cedar Breaks’ springs was never finished because the well owners didn’t allow access. Wildlife next: the agency’s biologists call the harm to the local pika population significant under every option. The forest already has only about 9 of the 40 goshawk breeding pairs its own plan requires, and the expansion would clear 117 acres of potential goshawk nesting habitat. Elk and mule deer habitat is in the analysis too, which matters to the hunters who know this high country.

A fair note: Skiers want this, and the resort is genuinely crowded: winter visits nearly doubled between 2016 and 2025. But the draft never studied upgrading inside the resort’s current footprint before reaching for 1,651 more acres.

Deadline: Thursday, Oct 29

Take action (2 minutes): Ask the Forest Service to study an upgrade-in-place alternative, and to require binding water agreements and the finished Cedar Breaks springs study before any approval:

Comment on Brian Head Expansion

You can also show up on last week’s threats:

The Mount Taylor uranium comment window closed Wednesday. Logs would be hauled over 325 miles of road, some of it in the wet season, and about 21 miles of new temporary road would be built.

Why it matters: Anglers and the Spring Chinook salmon that already struggle here. Fall Creek and two tributaries are listed as too warm for fish, and about 65% of returning Chinook die before spawning in an average year. The agency’s own analysis says the project is likely to harm them. Hunters lose too: the review never looks at deer and elk habitat.

Deadline: Wednesday, Oct 28

Take action (2 minutes): Ask the Forest Service for a real sediment and stream-temperature analysis, and to keep log hauling out of the wet season near Chinook habitat.

A fair note: Some forest groups support thinning young plantations like these. The fight here is over the scale, the wet-season hauling, and fish that are already in trouble.
<p class="button-wrapper" Lands.

You own about 640 million acres of land. So do I. So does every hunter, angler, hiker, rider, and rancher in the country. National forests, BLM land, wildlife refuges: they’re held in trust for all of us.

Right now, decisions about that land are being made in comment windows most people never hear about. A mine here, a drilling rule there, a land swap buried in a federal notice. Each one is small enough to miss. Together, they add up to losing what’s ours.

Here’s how this works. Every Thursday morning, you’ll get Three Threats Thursday:

🔴 The Big One: the threat with the most at stake this week

⏰ Closing Soon: the most important deadline in the next week or so

📍 From the Field: one specific place and the people fighting for it

Subscribe now

Each threat comes with one action that takes about two minutes and a real deadline. No long lists. No guilt. Ten minutes a week.

Keep public lands in public hands. That idea unites a lot of people who don’t always agree. Conservationists, hunters, anglers, hikers, and off-road riders all lose when public land is sold, closed off, or wrecked. When a fight splits those groups, I’ll say so plainly.

Why me?

Public lands aren't an abstraction to me. I've spent decades on them camping, hiking, backpacking, kayaking, and adventure motorcycling. Like many of you, I go there to recreate and experience wild places.

I started Save Your Public Lands because I've witnessed firsthand how special interests are working to steal, abuse, and destroy these lands for their own gain. As a former journalist, I know how to read the fine print, and I'm doing my part to keep our public lands — PUBLIC.

What I ask of you:

Subscribe. It’s free.

When you take an action, reply “done” or drop a 🌲 in the comments. I’ll share the count each week, so you can see we’re not alone.

Forward it to one person who loves a piece of public land.

I don’t run campaigns. I point you to the people who do, using sources like More Than Just Parks’ Public Lands Action Network, official federal notices, and groups from Backcountry Hunters & Anglers to The Wilderness Society. Every claim links to its source.

See you Thursday.

— Doug

Subscribe now
